NLRB Grants Review of Decision Allowing Scholarship Athletes to Unionize

The NLRB has granted review of the Regional Director’s decision allowing Northwestern University’s athletes to unionize. Although the Board acknowledges that Northwestern’s petition “raises substantial issues warranting review,” it is unlikely that the Regional Director’s decision was not undertaken without coordination with NLRB General Counsel Richard Griffin, and without the support of members of the Board.  It will be interesting to see what the NLRB does, and what effect this case has upon collegiate athletes and their relationship with their educational institution under other laws governing employment relationships.  No schedule for briefing has been set, and we will continue to monitor and issue updates regarding this important case.
